Filing an Appeal
To Appeal or Not

At Stanley, we always advocate to our clients to appeal decisions against their favor because the process is free to do, is typically done through a phone call with a hearings officer, and there is a high turnover rate. You have nothing to lose by appealing a disqualifying decision on your claim and a lot to gain.

With that being said, the process isn't always easy and there are filing dates, forms, and applications that must be taken care of in order to have an appeal. Helping individuals through this process, as well as representing you at the hearing is something Stanley thrives in.
What An Appeal Hearing Entails
Time
When the decision was entered- appeal hearings generally must be filed within a certain amount of time after a decision has been made on the claim. If you are past the designated time allotted, a special request will have to be made.
Opposition
Employer appeals: Like you, the employer also has the right to appeal a decision on your claim. Once an employer files the paperwork to appeal a favorable decision on your claim, notices will be sent to you, and if you fail to attend the hearing, the decision will most likely be in favor of the employer by default.
Documentation
Appeal decisions are made based on who provides the best information- building a solid case for why a decision should be overturned requires collecting information and documentation that gives legitimacy to your case and shows how you meet requirements of the law.
Comfortability
You will be directly asked questions in the hearing. Once all parties have entered the hearing, the hearings officer will be directly questioning both you and the employer in a very formal space. For some people, this can feel stressful and disorienting and make it hard for you to get your answers across to the judge correctly.
